Renter Agreement
Effective Date: April, 2026
1. Parties and Scope
This Renter Agreement ("Agreement") governs your use of the Navo platform as a Renter. By booking a vehicle, you agree to these terms in addition to Navo's Terms of Service, Privacy Policy, and any Host-specific rules. This Agreement is entered into between you ("Renter") and Navo, Inc. ("Navo"), a marketplace platform. The vehicle owner ("Host") is a separate, independent third party.
2. Renter Eligibility Requirements
To rent a vehicle through Navo, you must:
- Be at least 21 years of age (18 with a young driver fee in select markets).
- Hold a valid, unrestricted driver's license with a minimum of 1 year of driving history.
- Pass Navo's identity verification and driving record review.
- Have no DUI/DWI convictions within the past 7 years.
- Have no more than 2 at-fault accidents within the past 3 years.
- Have no more than 3 moving violations within the past 3 years.
- Not be listed on a sex offender registry.
- Possess a valid payment method on file.
Eligibility criteria may vary by vehicle tier and Host preferences.
3. Renter Responsibilities
3.1 Before the Trip
- Inspect the vehicle thoroughly at pickup and document any existing damage via the Navo app before driving.
- Review and acknowledge the Host's posted vehicle rules.
- Confirm the fuel type, EV charging protocol, or other operational requirements.
- Ensure all authorized drivers are added to the booking before the trip begins.
3.2 During the Trip
- Operate the vehicle safely and in compliance with all applicable traffic laws.
- Return the vehicle with the same fuel level (or battery charge level, for EVs) as at pickup, or pay the applicable refueling fee.
- Keep the vehicle clean and free of excessive mess; a cleaning fee may apply.
- Not exceed the odometer limit stated in the booking (if applicable); excess mileage fees apply.
- Report any accident, damage, breakdown, or incident to Navo within 24 hours.
- Not leave the vehicle unlocked or keys unattended.
3.3 After the Trip
- Return the vehicle to the agreed location at the agreed time.
- Late returns are subject to hourly overage fees.
- Failure to return the vehicle may be treated as theft and reported to law enforcement.
4. Authorized Drivers
Only Renters who have been approved and added to the booking may operate the rental vehicle. Allowing an unauthorized driver to operate the vehicle voids any protection plan and constitutes a material breach of this Agreement.
5. Prohibited Uses
Renters may not use the rental vehicle for:
- Any rideshare, delivery, or commercial transportation service (e.g., Uber, Lyft, DoorDash, Instacart).
- Towing or pushing any trailer, other vehicle, or heavy load unless expressly authorized.
- Racing, off-road driving, or stunt activities of any kind.
- Any illegal activity.
- Transporting more passengers than the vehicle's rated seating capacity.
- Travel outside the United States without prior written authorization.
- Transportation of hazardous materials.
6. Smoking and Pet Policy
Smoking of any substance (tobacco, cannabis, e-cigarettes, etc.) is strictly prohibited in all Navo rental vehicles. A minimum $250 cleaning fee will be assessed for any evidence of smoking.
Pets are permitted only if explicitly allowed in the Host's listing. A pet fee may apply. Evidence of unauthorized pets may result in a cleaning fee of up to $150.
7. Damage and Liability
7.1 Renter Liability
Renters are liable for all damage to the rental vehicle that occurs during their trip, including damage from third parties if the Renter was negligent. Damage includes physical damage, interior damage, and damage from misuse (e.g., wrong fuel type, flooding an EV).
7.2 Protection Plans
Navo may offer optional protection plans that limit Renter financial exposure for certain damage events. Protection plans are not insurance. Review plan terms carefully before booking. Certain incidents (prohibited use, DUI, unauthorized driver) are never covered.
7.3 Your Own Insurance
Renters may be covered by their personal auto insurance or credit card benefits for certain rental events. Navo strongly recommends confirming coverage with your insurer before renting. Navo is not responsible for any gaps in personal insurance coverage.
8. Accidents and Incidents
In the event of an accident:
- Ensure the safety of all parties. Call 911 if necessary.
- Do not admit fault.
- Document the scene with photos.
- Collect the other party's insurance and contact information.
- File a police report if required by law or if damage exceeds a minor threshold.
- Notify Navo through the app within 24 hours.
Failure to report an accident may result in the Renter being held fully liable for all damage and costs.
9. Renting at Your Own Risk
You acknowledge that renting and operating a motor vehicle involves inherent risks, including the risk of accident, injury, property damage, and death. You assume all such risks. Navo is a marketplace platform only and shall not be liable for any injury, loss, or damage arising from your use of a rental vehicle, the condition of the vehicle, or the acts or omissions of any Host. You agree that your sole remedy for any vehicle-related dispute is with the Host, subject to Navo's dispute resolution process.
10. Waiver and Release
By completing a booking, you knowingly and voluntarily waive and release Navo and its affiliates, officers, directors, and employees from any and all claims, demands, damages, and causes of action arising out of or related to your rental, your use of any vehicle, any accident or incident during your trip, and any actions or omissions of any Host.
11. Fees and Charges
Navo may charge Renters for the following in addition to the rental rate: platform service fee, young driver fee (if applicable), excess mileage fee, fuel/charging shortfall fee, late return fee, cleaning fee, smoking fee, unauthorized driver fee, damage assessment, and any applicable taxes.
12. Cancellation
Cancellation terms are governed by Navo's Cancellation Policy, which may vary by booking type and timing. Renters acknowledge that late cancellations may result in partial or full forfeiture of the rental fee.
By booking through Navo, you acknowledge that you have read and agree to this Renter Agreement.
